Ordinance #395 - Noise and Light Nuisance

Ordinance amended 5/18/2022 - This ordinance provides standards that limit noise and light pollution within Whitpain Township as follows: 

This ordinance defines nuisance disturbance by noise and those acts that constitute disturbing the peace and are prohibited within the township.  Ordinance defines quiet hours and the decibel levels permitted during both quiet and non-quiet hours. 

This ordinance defines nuisance disturbance by light and those acts that constitute disturbing the peace and are thus prohibited within the township.

Ordinance #399 - Meadows

Ordinance amended 5/18/2022 - This ordinance provides requirements for the establishment of Natural Landscapes and Meadows within Whitpain Township.   

While it is understood that Natural Landscapes and Meadows, comprised of native plants, provide many environmental benefits, this ordinance provides requirements intended to prevent substantial and unreasonable interference with the use and enjoyment of neighboring property.  These requirements include location on property, signage, permitting, and the establishment and implementation of an effective management and maintenance plan.

 Ordinance #404 - Bamboo

Ordinance enacted 8/18/2022 - This ordinance was enacted to provide regulations pertinent to any property owner or resident who has planted and/or grows Bamboo, or maintains Bamboo on their property, or permits Bamboo to grow or remain on the property. 

The ordinance was enacted because: 

Certain types of bamboo grow and spread vigorously by encroaching onto neighboring properties and continue to multiply, which can be a nuisance to neighbors 

The rootstalks of bamboo form dense colonies that crowd out other understory plants, thereby decreasing biodiversity 

Bamboo is extremely difficult to remove, and the process for removal may take multiple years and may include measures that are harmful to the environment such as herbicide use or burning.
